This Creator Partnership Agreement ("Agreement") is entered into between:
Blink Travels Ltd ("Blink Travels", "we", "our", or "us")
and
The Creator ("Creator", "you", or "your"),
effective from the date your application to the Blink Travels Creator Program is approved.
1. Purpose
The purpose of this Agreement is to establish a partnership where the Creator promotes Blink Travels and refers tourism businesses to join the Blink Travels platform.
The Creator earns commissions when eligible referrals generate qualified leads according to this Agreement.
2. Creator Responsibilities
As a Creator you agree to:
- Promote Blink Travels honestly and professionally.
- Introduce tourism businesses that may benefit from Blink Travels.
- Share your official Blink Travels referral link or referral code.
- Represent Blink Travels positively.
- Follow all applicable laws and advertising regulations.
- Avoid misleading statements or false promises.
The Creator is an independent contractor and is not an employee of Blink Travels.
3. Referral Attribution
A business will be considered referred by the Creator only when:
- the business signs up using the Creator's referral link or code; or
- Blink Travels successfully attributes the business to the Creator.
Blink Travels reserves the right to determine referral attribution where duplicate claims exist.
4. Commission
When an eligible referred business receives qualified leads through Blink Travels, the Creator earns:
20% of Blink Travels' lead revenue
This commission is calculated only on revenue earned by Blink Travels, not on the business's sales or bookings.
Example:
Business receives a qualified lead.
Blink Travels charges:
USD 5.00
Creator earns:
USD 1.00
5. Commission Period
Creator commissions remain active for:
Six (6) months
from the date the referred business successfully joins Blink Travels.
After the commission period expires, future revenue from that business belongs solely to Blink Travels.
6. Pending and Available Earnings
To protect against fraud and incorrect payments:
New commissions first enter:
Pending Balance
Blink Travels manually reviews earnings.
Approved earnings are moved to:
Available Balance
Only Available Balance can be paid.
7. Payment Schedule
Blink Travels currently processes creator payments:
Once every month
Payments may be made through:
- M-Pesa
- Bank Transfer
- Other supported payment methods
Blink Travels may change the payment schedule with reasonable notice.
8. Minimum Payout
Blink Travels may set a minimum withdrawal amount before payment is processed.
(Current minimum payout will be communicated inside the Creator Dashboard.)
9. Fraud Prevention
Blink Travels may reject or reverse commissions resulting from:
- fake businesses
- duplicate referrals
- self-referrals
- fake leads
- bots
- automated traffic
- misleading advertising
- spam
- any fraudulent activity
Fraud may result in:
- cancellation of commissions
- account suspension
- permanent removal from the Creator Program
10. No Guarantee of Earnings
Blink Travels does not guarantee:
- any specific income
- any minimum number of referrals
- any number of qualified leads
- future commissions
Creator earnings depend entirely on referral performance.
11. Marketing Materials
Blink Travels may provide:
- logos
- images
- videos
- media kit
- brand assets
These materials remain the property of Blink Travels and may only be used for promoting Blink Travels.
12. Taxes
Creator is responsible for their own taxes.
13. Intellectual Property
The Blink Travels name, logo, trademarks, website, and platform remain the exclusive property of Blink Travels.
Nothing in this Agreement transfers ownership of Blink Travels intellectual property to the Creator.
14. Confidentiality
Creators agree not to disclose confidential information including:
- internal business information
- commission calculations
- private platform information
- unpublished features
- customer information
This obligation continues even after leaving the Creator Program.
15. Independent Relationship
Creators are independent partners.
Nothing in this Agreement creates:
- employment
- agency
- partnership
- joint venture
between Blink Travels and the Creator.
Creators are responsible for their own taxes and legal obligations where applicable.
16. Termination
Either party may terminate this Agreement at any time.
Blink Travels may immediately terminate participation for:
- fraud
- abuse
- policy violations
- misuse of the Blink Travels brand
- illegal activity
Approved commissions earned before termination may still be paid, provided they comply with this Agreement.
17. Limitation of Liability
Blink Travels shall not be liable for:
- indirect damages
- loss of business
- loss of profits
- interruptions
- technical outages
Creator participation is at the Creator's own risk.
18. Changes to the Program
Blink Travels may update:
- commission rates
- payment schedules
- program rules
- platform features
Creators will be notified of material changes through email or the Creator Dashboard.
Continued participation constitutes acceptance of the updated terms.
19. Governing Law
This Agreement shall be governed by the laws of 'you', 'your', 'creator' country of origin.
Any disputes shall first be resolved through good-faith discussions before either party seeks legal remedies.
20. Acceptance
By joining the Blink Travels Creator Program, the Creator confirms that they:
- have read this Agreement;
- understand its terms;
- agree to be bound by it.
